Section 504 of the Rehabilitation Act |
Children who exhibit a
disability but are not eligible for special education services may be eligible
for accommodations under Section 504.
A "disability" under Section 504 is defined as "a physical or mental
impairment that substantially limits one or more of the major life activities"
of an individual. Major life activities include functions such as the following:
* caring for oneself
* performing manual tasks
* walking
* seeing
* hearing
* speaking
* breathing
* learning
* working
Decisions are made only through a Section 504
Team. The Team must include people who are knowledgeable about the
child, the disability, the meaning of evaluation data, and program
options. Decisions must be based on current information, and planning
should be individualized. Parents must be provided with a written
acknowledgement of due process rights which are guaranteed by federal law.
